Terms & Conditions
Last updated: Draft, not yet approved.
DRAFT — this text is a working draft and must be reviewed by a lawyer before launch. Company name, organisation number and address are placeholders.
1. Account use
An account is for the person or business that creates it. You are responsible for keeping your login details private and for everything done through your account. Accounts may not be shared or resold.
2. Customer responsibility for content
You decide what goes into your guide. You are responsible for making sure your texts, prices, house rules, safety information and photos are accurate, lawful and up to date, and that you have the right to use any material you upload.
3. Intellectual property
The platform, its design, code and templates remain our property. Your own texts, logo and photos remain yours; you grant us the licence needed to display and translate them inside your guide.
4. Subscriptions and cancellation
Subscriptions run month to month unless agreed otherwise, and renew automatically until cancelled. You may cancel at any time with effect from the end of the paid period. One-off Done For You setup fees are not part of the subscription.
5. Privacy and personal data
We process personal data as described in our Privacy Policy. Guests can read a guide without creating an account.
6. Data storage
Guide content is stored on servers operated by our hosting providers. In this prototype version, content you enter is stored only in your own browser.
7. Cookies
We use necessary cookies to run the service, and optional cookies only with your consent. See the Cookie Policy.
8. Third-party services
We rely on third parties for hosting, email, payment and translation. Those providers process data on our behalf under their own terms.
9. Service availability
We aim for continuous availability but do not guarantee uninterrupted service. Maintenance, updates and events outside our control may cause downtime.
10. Limitation of liability
To the extent permitted by law, our liability is limited to the amount you paid for the service in the twelve months before the claim. We are not liable for indirect loss such as lost bookings or lost profit.
11. Free trials
A free trial is a temporary service for evaluating Smart Digital Guide. Guides published during a trial are clearly labelled as a trial, and stop being visible to guests when the trial ends unless a paid plan is activated. Your guide address, content and printed QR codes are kept and continue to work once a plan is active. Trial materials you print or share must keep the trial label we provide.
12. Honest presentation and resale
You may not present a free trial guide to guests, property owners or other customers as a finished, paid or permanent service, and you may not sell, sublicense or charge for access to a trial guide. Reselling Smart Digital Guide, or setting up guides on behalf of other property owners commercially, requires a written partner or reseller agreement with us; approved partners may do so on the terms of that agreement. The account holder is responsible for everything published from the account.
